WE ARE THRILLED TO BE HOLDING OUR FALL FASHION GALA ON THURSDAY, SEPTEMBER 30

New York City Ballet remains deeply committed to the health and safety of our guests, artists and staff. The David H. Koch Theater (the "Theater") in compliance with developing guidelines issued by federal, state, and local governments, has put in place preventative measures to try to reduce the spread of COVID-19.

With safety for all at the forefront, New York City Ballet will be implementing a mandatory vaccination policy for all employees and visitors to the Theater. Upon entering the Theater, every Gala attendee and audience member will be required to show in-person proof of full vaccination against COVID-19, as authorized by the FDA or WHO.  At this time, children under the age of 12, for whom there is currently no available vaccination, will not be permitted to attend. As a further tool to mitigate the spread of COVID-19, NYCB will also require proper mask usage for all patrons, regardless of age or vaccination status while in the Theater.

As has been announced, all Gala event activity, other than the performance, will take place outdoors, where masks can be removed.

Additional theater safety measures include upgraded auditorium ventilation systems with MERV 15 filters, and rigorous cleaning and sanitation protocols throughout the building. Based on CDC, New York State and New York City guidelines at the time of the Gala, additional safety protocols may include: contact tracing survey, limitations on belongings in the Theater, contactless temperature check, social distancing, and more.

Specific health & safety protocols are determined by the Theater in its sole discretion and are subject to change. We will continue to consult with medical advisors and monitor CDC and New York City and State guidelines, and these policies may be updated as conditions evolve. We will communicate substantial changes to health and safety protocols in advance of the Gala evening, and will also update this page with new information as it becomes available.

The Theater may, in its sole discretion, refuse to allow admission to any Ticket Holder who does not comply with the Theater's policies.

COVID-19 Acknowledgment

Ticket Holder acknowledges and agrees there are inherent risks to health and safety associated with attendance at the Fall Fashion Gala. Risks include, but are not limited to, the possibility of contracting COVID-19, a variant of COVID-19, and other communicable diseases (collectively, "Illnesses") any of which can result in unforeseen impacts on one's health and, in some cases, loss of life. Ticket Holder acknowledges the decision to attend the Fall Fashion Gala is voluntary, solely within Ticket Holder's discretion, assumes all risks, and understands the Theater does not and cannot prevent the spread of such Illnesses.

If you feel ill or test positive for COVID‐19 you agree not come to the Theater, given that vaccinated individuals can still contract and spread COVID-19.

COVID-19 Waiver

In consideration of being permitted to attend and by attending the Fall Fashion Gala in addition to Ticket Holder's agreement to be bound by the terms and conditions printed on the ticket, posted at the Theater, and on the Theater website, Ticket Holder acknowledges and assumes the inherent risks associated with the above COVID-19 Acknowledgment. Ticket Holder and anyone acting on Ticket Holder's behalf , knowingly and voluntarily releases the Theater, and without limitation, its Board of Directors, its officers, employees, performers, agents, and affiliates and/or any person or entity acting on their behalf (collectively, the "Theater Releasees"), waives all claims of liability and damages either at law or in equity, to the fullest extent permissible by law, that could be brought against the Theater Releasees, and relinquishes all rights to bring any claim or recover any damages associated with injury or loss of life against the Theater Releasees in connection with exposure or infection with such Illnesses arising out of entry into and/or attendance at the Fall Fashion Gala regardless of any acts (unless willful), or any other type of fault, misbehavior or failure to act of the Theater Releasees.

Ticket Holder understands and agrees that this Agreement is subject to and will be construed in accordance with the laws of the State of New York, without regard to choice or conflict of law provisions. If any provision in this Agreement is declared illegal, void, or otherwise unenforceable Ticket Holder agrees that such provision or part thereof will be deemed severable and all other provisions contained herein remain valid and binding with full force and effect as if the severed provision or part did not exist.
